1. GENERAL PROVISIONS

These Terms of Use (hereinafter referred to as "Terms") govern the use of the website https://irenagigovic.com/ (hereinafter referred to as the "Site") and the services provided by Irena Gigović, Entrepreneur (hereinafter referred to as "we", "us", "our" or "Service Provider").

By using this site, you accept these Terms in full. If you do not agree with any part of these Terms, please do not use our site.

3.2. Method of providing services

  • Consulting services are provided online and on-site
  • Consultations can be held via video call, phone or in person
  • Skills trainings are organized for private groups (minimum 7-10 participants, depending on the type of training)
  • Trainings are held in Serbian, with material provided in English
  • Online services require appropriate technical equipment (Microsoft Teams or similar platforms)
  • All details of the service are defined in an individual contract

4. ORDERING AND CONTRACTING SERVICES

4.1. Ordering process

  1. Contact via the contact form on the website or directly by email/phone
  2. Initial conversation about needs and requirements
  3. Creating a personalized offer
  4. Signing of the contract on the provision of services

4.2. Contract

  • All service details, price, terms and conditions are defined in a written contract
  • The contract comes into force after signing by both parties
  • Amendments to the contract are possible only with the written consent of both parties
  • An offer is considered accepted if we receive your acceptance within 7 days of sending the offer

4.3. Notices prior to commencement of service

No later than four days before the start of the training or consultation, clients will receive a call with detailed information. The call contains the start date, location or web link, technical data required for a successful connection

5. PRICES AND PAYMENT

5.1. Prices

  • Service prices are individually defined for each project
  • All prices are expressed in dinars (RSD) or euros (EUR)
  • Prices do not include VAT, which is calculated according to current regulations
  • Prices are subject to change, especially for promotional offers

5.2. Payment method

  • Payment is made exclusively by pro-invoice or invoice
  • Payment to the business account by bank transfer
  • There is no possibility to pay by card through the site
  • The invoice is delivered within two days of acceptance of the offer
  • Payment terms are defined by the contract (standard 7 days from receipt of invoice)

5.3. Late payment

  • In case of late payment, we reserve the right to suspend services
  • The contract is considered terminated in case of non-payment within the stipulated period
  • Default interest may be charged according to applicable law

6. CANCELLATION AND REFUND

6.1. Consulting services

  • The client can cancel an individual consultation with a written notice at least 48 hours before the appointment
  • There are no refunds for services already performed
  • Cancellation of long-term projects is regulated by an individual contract
  • Until the invoice is paid, the customer can unilaterally terminate the contract by submitting a written notice

6.2. Skills training

  • Due to the nature of group trainings and the need to provide lecturers, space and materials, there are no refunds for canceled trainings
  • The following changes are allowed:
    • Substitution of participants with notification at least 24 hours before the training
    • Shifting the date of the training with a notice at least 14 days before the scheduled training (subject to the availability of appointments)
    • All changes must be confirmed in writing (email).
    • Payment is considered as a guarantee of the attendance of the named participants

6.3. Refund exceptions

Refunds are only possible in the case of:

  • Service Provider Terminations
  • Extraordinary circumstances (Force Majeure) when the service cannot be maintained or moved
  • Impossibility of organizing the service within the prescribed period

6.4. Cancellation by Service Provider

We reserve the right to cancel the service in case of:

  • Non-payment within the agreed term
  • Inappropriate behavior of the client or training participant

6.5. Extraordinary circumstances and date changes

In case of extraordinary circumstances, the service must be provided no later than 60 days from the originally determined date

  • For technical problems (electricity, internet) or unplanned absence of the lecturer - no later than 60 days
    • Such changes do not constitute a justified reason for termination of the contract by the client
    • If we fail to arrange the service within the stipulated time, we will issue a refund within 15 days

7. INTELLECTUAL PROPERTY

7.1. Site content

  • All content on the site (texts, images, video materials, design) is protected by copyright
  • Copying, distribution or commercial use without written permission is prohibited
  • You are granted a limited license for personal and non-commercial use

7.2. Materials created during the provision of the Services

  • All materials, analyzes and documents created specifically for the client become the property of the client
  • General methodological approaches, know-how and training materials remain the property of the service provider
  • Video materials and training content can only be used by participants who attended the training
  • Training participants may not reproduce or share training materials without permission

8. TRAINING – SPECIAL CONDITIONS

8.1. Organization of training

  • Trainings are organized for private groups with a minimum of 7-10 participants (depending on the type of training)
  • The maximum number of participants is defined according to the type of training
  • Trainings can be held at our premises, the client's premises or online

8.2. Obligations of participants

  • Regular attendance at trainings
  • Active participation in exercises and discussions
  • Respect for other participants and lecturers
  • Keeping the information of other participants confidential

8.3. Certification

  • Upon completion of the training, certificates of attendance are issued
  • Certificates are issued only to participants who have attended a minimum of 80% training
  • The final email with the certificate and additional materials is delivered no later than three days after the training

9. LIMITATIONS OF LIABILITY

9.1. Limitations

  • Our liability is limited to the value of the contracted service
  • We are not responsible for indirect damages or lost profits
  • The Services are provided "as is" without warranties other than those expressly stated

9.2. Exceptions

We are not responsible for damages caused by: 

  • Improper use of our recommendations
  • External factors beyond our control
  • Non-compliance with our instructions by the client
  • Absence of participants for training for personal reasons
  • Inadequate technical configurations of the client
  • Access restrictions from the client's work environment

10. CONFIDENTIALITY

  • We treat all information we receive from clients as confidential
  • We undertake not to share business information of clients with third parties
  • Clients also undertake not to share our methodologies and know-how
  • Training participants undertake to keep the information of other participants confidential

11. USE OF THE SITE

11.1. Permitted use

  • You may use the Site for lawful purposes
  • You can read the content and contact us for services

11.2. Prohibited use

  • Hacking, violation of site security
  • Installation of malicious software
  • Copying content without permission
  • Using the site for illegal activities
  • Access to the site by automated means (robots, scripts)

11.3. User obligations

  • All information you provide must be true, accurate and complete
  • You agree to update the information when necessary
  • You have legal capacity and agree to be bound by these Terms

12. PROTECTION OF PERSONAL DATA

  • We care about the privacy and security of your data
  • Use of the site implies acceptance of our Privacy policies
  • We store the data needed to manage the site's performance
  • You are responsible for the data you transmit to the site
    • We make regular backups, but we are not responsible for data loss

13. CHANGES TO THE TERMS

  • We reserve the right to change these Terms at any time
  • We will inform users about significant changes via the website or email
  • Continued use of the site after changes means acceptance of the new terms
  • Changes are valid only if they are published on the site

14. ELECTRONIC COMMUNICATIONS

  • Visiting the site and sending email messages constitutes electronic communication
  • You accept electronic communications as valid
  • You accept the use of electronic signatures and contracts
  • You waive the right to original signatures and non-electronic records

15. APPLICABLE LAW AND DISPUTE RESOLUTION

15.1. Applicable law

These Terms are interpreted according to the laws of the Republic of Serbia

15.2. Dispute resolution

  • Disputes are resolved peacefully through negotiations
  • In case of impossibility of a peaceful settlement, the court in Belgrade is competent
  • Before starting court proceedings, an attempt at mediation is mandatory
  • The provisions of the Terms and Conditions also apply to contracts that were not concluded electronically

16. FINAL PROVISIONS

16.1. Importance of conditions

  • If any provision of these Terms becomes invalid, the remaining provisions will remain in effect
  • These Terms constitute the entire agreement between us and the user
  • They do not create a partnership, employment or agency relationship

  • In the case of translation, the Serbian version takes precedence
